Supreme Court Backs Reservists’ Job Protections

The Supreme Court ruled Wednesday that a former state trooper had standing to sue Texas over his claim that he was forced out of his job when he returned from an Army deployment to Iraq.

Le Roy Torres sued under a 1994 law that strengthened job protections for returning service members, but Texas argued it was shielded.

“Text, history and precedent show that the states, in coming together to form a union, agreed to sacrifice their sovereign immunity for the good of the common defense,” Justice Stephen Breyer wrote in the 5-4 ruling, as Military Times reported.
