Federal Judge Denies Stay Allowing Use of Pentagon Funds for Barrier Construction

June 2, 2019

A federal judge blocked an administration request Thursday to resume using DOD funds to build southern border barriers while they appeal the judge’s ruling halting use of those funds, The Hill reported Friday.
California District Court Judge Haywood Gilliam Jr. had issued a previous ruling that blocked the transfer of funds from Pentagon counter-drug accounts. On Thursday Gilliam again decided against the administration’s request to pause his initial ruling.
The administration had requested a stay “so that construction and funding for these two border barrier projects can continue.”
The officials said that they will appeal their case to the 9th Circuit Court of Appeals.
